Family Law FAQ

For married or civil-union couples in Quebec, the family patrimony includes the family residences, furniture, vehicles used by the family and rights accumulated in retirement plans. Its value is divided equally on divorce, whatever the matrimonial regime.
Not entirely. Under the Civil Code, de facto spouses have no family patrimony and no spousal support between them. Since June 30, 2025, however, those who become parents of a child born or adopted after that date are subject to the parental union regime. Obligations toward children apply in every case.
In Quebec, it is set under the Regulation respecting the determination of child support payments, based mainly on both parents' incomes, custody time and the number of children.
Every decision concerning a child is made in the child's interest (Civil Code of Québec, art. 33): their needs, age, health, environment and each parent's ability to meet them.
No, but parents generally must attend a parenting-after-separation information session before a contested hearing. Quebec's family mediation service also offers free mediation hours to couples with children.
