FAQ

Criminal Law FAQ

You have the right to remain silent and the right to retain and instruct counsel without delay (Canadian Charter of Rights and Freedoms, s. 10(b)). Exercise these rights and avoid making a statement to police before speaking with a lawyer.
Summary conviction offences are the least serious: the procedure is simpler and maximum penalties are lower. Indictable offences cover more serious crimes. For "hybrid" offences, the Crown chooses how to proceed.
Yes. A conviction can make a permanent resident or foreign national inadmissible to Canada (Immigration and Refugee Protection Act, s. 36). If you are not a Canadian citizen, speak with a lawyer before pleading guilty or accepting a deal.
The Parole Board of Canada can order a record suspension after a waiting period that starts once the full sentence is completed: 5 years for a summary offence and 10 years for an indictable offence.
We review the charges, your release conditions and the available evidence, then explain your options and the steps of the process. Your communications with the lawyer are protected by solicitor-client privilege.
